Anotace
Article 16 of Directive 98/44/EC of the European Parliament and of the Council of 6 July 1998 on the legal protection of biotechnological inventions requires the Commission to publish annually a report on the development and implications of patent law on biotechnology and gentic engineering. Following the publication of the first such report - COM(2002) 545 - in October 2002, the Commissions Directorate Generals' Internal Market and Research have set up a group of experts from science, industry and patent law in December 2002 to advise and assist it in preparing future annual reports. The current publicaiton consists of an extensive background paper prepared by Professor Sven Bostyn for the groups meeting on March 27th 2003, which dealt with the scope to be given to patents related to sequences or partial sequences of genes isolated from the human body, as well as a summary of the groups discussion and conclusions.
